FINAL JUDGMENT ~ 'i THIS CAUSE came on regularly for trial before the Court i without intervention of a jury on March 31, 1977. The Court, ~ ! having heard the testimony, examined the proofs offered by the ~ ~ respective parties and having heard and considered the arguments of counsel, finds therefrom as follows: 1. That a contract was entered between the Third Party Plaintiff and Third Party Defendant on January 7, 1974. 2. That said contract contained an incorrect description of the total amount of work to be done thereunder. 3. That under said Contract, Third Party Plaintiff was to ~ be paid on a unit-price basis for the amount of earth excavated. ~ 4. That Third Party Plaintiff has established a claim against Third Party Defendant in the amount of $28,235.60, for additional work done under said Contract. 5. That Third Party Plaintiff breached said Contract by failing to perform its terms wi~ the six month period provided for therein. /~OM~ 1~ J~
