THiS IS A PURCHASE MONEY SECOND MORTGAGE.

li SPECIAL MORTGAGE CLAUSE: It is specifically agreed and understood
, that ROBERT C. HARDWICK and ETHEL HARDWICK, his wife, did assume and ~
i agree to pay a certain existing mortgage from Harry J. Ricliter, JR. ;
~ to Evelyn I. Hester, dated December 29, 1972, and recorded in O.R. ;
~ ~ Book 209, page 1602, of the public records of St. Lucie County,
` j Florida; that said r.~ortgage is a valid lien upon the land being pur-
` chased by BEN STEWART and pZANE~-LES- STEWART, his wife, herein, but
said existing lien above-referenced is not assumed by the STEWARTS.
The HARDWICKS shall be responsible for monies due under the~unassume
wrap-around mortgage. The HARDWICRS shall make payment when due of
all installments without any reference to grace period, and shall pr -
vide the STEWARTS with a certificate of payment by certified mail.
In the event HARDWICKS fail to make payment, the STEWARTS, at their
i~ option, may, within the grace period of the unassumed mortgage, be
entitled to make payment and, in such event, to the extent of the
> payment, shall receive credit for said payment against the purchase
~ money second mortgage herein from the STEWARTS to the HARDWICRS.
Nevertheless, the STEWARTS shall have no duty to make payment of the
- = unassumed mortgage hereinreferenced.

Alternatively and cumulatively, the HARDWICKS agree to
~ L~~~ indemnify and hold harmless the STEWARTS from any and all liabilitie ~
;~a I~ under the unassumed underlying mortgage and in the event of any de- ~
~ fault or foreclosure action o~ legal action instituted as a result
F ~ o~! of the default of the HARDWICKS, then and in that event, the HARDWIC S ~
shall indemnify and hold harmless the STEWARTS from all judgments,
suits, orders, decrees, including attorneys' fees and Court costs, •
occasioned by any such default by the HARDWICKS.
