BEFORE lyE, the undersigned suthority, personal2y
appeared DOLORES ANN SMITH, who after being duly sworn deposes
and states:
1. The marriage exist~.ng between my former husband,
PETER CAYLEY SMITH, a/k/a PETER C. SMITH and I was dissolved
on Sune 2Y, 1976 by Order of the,Circuit Court of the Eleventh
Judicial Circuit In And For Dade County, Florida, in Case
No. 75-20177.
2. At the time of the dissolution of my marriaqe as
aforesaid, my former husband and I were owners of the following ~
described property as tenants by the entireties:
Condominiwn Parcel No. 234 of CAPSTAN I,
according to the Declaration of Condominium
thereof, recorded in O.R. Sook 232, at
Pages 619 throuqh 711 of the Public Recorda
of St. Lucie County, Florida.
~ By virtue of said Dissolution of Marriage I became a tenant in
common with the said Peter Cayley Smith of the above-de~scribed
property.
3. It has recently come to my attention that on
the 14th day of December, 1976 there was recorded in the Public
Records of St. Lucie County a mortgage encumbering the above- _
described property which said mortgage was purportedly signed by
the said Peter Cayley Smith and Dolores Ann Smith and which
said mortgaqe secured a pro~issory note in the amount of $67,900.00.
~ bearing date of December 7, 1976, purportedly signed by the said
Peter Cayley Smith and Dolores Ann Smith. The said martgage and
note constitute a forgery in that I did not sign either the said
