WHEREAS, the sewage line, constructed to serve each such i

single-family dwelling is, or may be, located in whole or in • ' '

part upon a single parcel of real property described in Schedule ~
A, thouqh it has been constructed and designed to serve the '

adjacent parcel described in Schedule A and~the separate dwellinq :

unit situate thereon; and
WHEREAS, Owner is desirous of declaring each of said comanon
walls to be party walls, and is further desirous of setting
forth the respective rights and duties of the successors in title ~

to Owner of the sinqle-family dwellings sharing said party walls, ;
as well as their heirs, successors, assigns and grantees; and i

WHEREAS, Owner is further desirous of declaring the sewage ~

line serving the two single-family dwellings situate upon the ~
i
Tracts more fully described above as a party facility, and wishes
to set forth the respective rights and duties of the successors
in title to Owner of the separate single-family dwellings served
by said sewage lines, as well as their heirs, successors, assigns
and grantees; •
NOW, THEREFORE, the premises stated, it is hereby declared

' as to the two single-family dwellings situate upon the above

~ described Tracts that:
1. The common wall shared by the two single-family dwelling ~
structures, and located on the line dividing each of the
tracts more fully described above into two separate, ~
distinct and approximately equal parcels of real property,
said parcels as more particularly described in Schedule A,
appended hereto and made a part hereof, shall be party
walls for the perpetual benefit of and use by the ~
successors in title to Owner, their heirs, suCcessors, ~
assigns and grantees. ~

2. The common sewage line shared by the two single-family ~
dwelling structures situated upon each of the above
described tracts, though the same may be located in
whole or in part upon but one of the two parcels into
~ which said tracts have each been divided, as more
~ particularly described in Schedule A, appended hereto
and made a part hereof, shall be a common sewage line
facility for the perpetual benefit of and use by the
successors in title to Owner, their heirs, successors, ~
assigns and grantees. . ~
