THIS CAUSE came on to be heard before me on the 24 day
~ of May, 1977 on the Motion to Dismiss filed herein by the Def-
endant, JAMLS K. JONES, individually and d/b/a FORT PIERCE TIRE
AND MUFFLER C0. The Court heard the argument of counsel for the
Plaintiff and the argument of counsel for the Defendant. Having
considered the'arguments of counsel and being otherwise duly

i advised in the premises, this Court finds and determines that

F COMERCIAL FUNDING. INC., was dissolved at the time the contract

~ in question was entered into, that it~is dissolved at the present
time, that as a result the contract is not enforceable by the
assignor and that theref~rP the cc~ntract i~ not enforceabl~ by
the assignee as well. Zt is thereupon,
ORDERED AND ADJUDGED that the Motion of the Defendant.
