The_Plaintiffs, R. H. CUTL$R and AWRSY M. CUTLER,
- nave the Court to enter its order herein qrantinq a new
trial to the plaiatiffs on the f~llowing grounds:
l. The jury's verdict is contrary to the manifest -
_ weiqht of the evidence in that by the defendant's own
evidenae there was soane degree of neqliqence on the part of
the defendant.
2. The Court erred in qivinq an instruction on the
doctrine of.last clear chance in that the instruction as
qiven did not properly state the law of the State of Georqia
and was not applicable under the facts of the instant case.
- I HEREBY CERTIFY that a true-copy of the foregoing has
