relationship with Rachel Padget Piled individual U. S. Income
Tax Returns in which he stated under penalty of per~ury that
he was a single person; 2. Rachel Padget likewise filed
individual U.S. Income~Tax Returns in which she stated that
she was a single person; 3. Rachel Padget continually used
the name Rachel Padget on offical documents such as driver's
license, automobile insurance and her Registered Nurse registration
and in the newspaper obituary notice of the decedent's death
Rachel Padget, without ob~ection, allowed her name to be listed
as "close companion".

There is no issue of material fact and the Personal Re-
presentative is entitled to a Summary Judgment as a Matter of
Law. The Court being fully advised~ it is upon consideration
(~ItDERED AND ADJUDGED that the ~iotion for Siunmary Judg-
ment by the Personal Representative be, and the same is hereby
granted, and that the Petition for Family Allowance and Election
to take Elective Share are each hereby disallowed and dismissed
with prejudice. '
