Comes now Clayton Trust Company (Petitioner), sole ~ -
trustee of the Testamentary Trusts created under the Last
Will of Erwin T. Huber, deceased, and states:
- 1. That the vast majority of the assets pf the trust
estate, when received in trust, were nonrevenue producing
real property and the trust has embarked upon the systematic
liquidation thereof in order to be in a position to fully attain
the objectives of the within trust.
2. Said Trust owns an undivided one-half interest in
ap~roximately 173 acres of unimproved real property located
in St. Lucie County,~Florida, which property is more particularly
described in a certain instrument accepted by Petitioner on

i riaYch~ 1, 1977 (subject to approval of this.Court), and entitled
~ "Deposit Receipt and Sale and Purchase Agreement", a copy of
E ~ which is attached hereto as Exhibit A.

~ 3. That the Fetitoner and one l~rthur Wolff, as ancillary
, administrator of the estate of D. Alviena Huber, deceaseci, and
as ancillary guardian of the same persons who are the beneficiaries
of the within Trust, are the owners of the remaining undivided
interest and all.have entered into an agreement to sell the
same for a~urchase price of $185,000.00. Extiibit A is a true

~ appraisal of said property prepared by Indian River Appraisers,
~ Inc., Stuart, Florida, stating that in said appraiser's
opinion, the estimated market value of said property as of
