PROVISIONS OF CERT~iIN CONTRACTS RELATING THERETO
' Comes now Clayton Tr~xst Company (Petitioner), sole
trustee of the Testamentary Trusts created under the Last ~
Will of Erwin T. Hub~er, deceased, and states:
l. That the vast majority of the assets of the trust
estate, when received in trust, were nonrevenue producing ~
real property and the trust has embarked upon the systematic
liquidation thereof in order to be in a position to fully
attain the objectives of tfie within trust.

'i - 2. ~Said Trust owns approximately an undivided one-half

~ interest in approximately 173 acres of unimproved real
f property located~in St. Lucie County, Florida, which pro-

~ ~ perty is more particularly described in a certain instrument
~ accepted by Petitioner on July 22, 1976 (subject to approval
of this Coart), and entitled "Sale and Purchase Agreement",
a copy of which is attached hereto as Exhibit A. }

3. That the Petitioner and one Arthur Wolff,.as ±

ancillary administrator of the estate of D. Alviena Huber, ~

deceased, and as ancillary guardian of the same persons who ~
~

are the beneficiaries of the within Trust, are the owners of
~
~ the remaining undivided interest and all have entered into ;

~ an agreement to sell the same for a purchase price of
~
~
~ $185,000. Exhibit A is a true and correct copy of the
