appraisal of said property preared by India~ River Appraisers, ~
Inc., Stuart, Florida, stating that in said appraiser's ~
opinion, the estimated market value of said property as of ~j
September 14, 1976, is $185,000. A copy of appraiser's
letter of transmittal accompanying said appraisal report is
attached hereto as Exhibit B.

5. That in effecting said sale the trust will incur ~

certain expenses in the nature of real estate comanissions =

and/or consultinq fees, title expenses, and legal fees and
has incurred certain fees and expenses as of.the date

6. Ttiat the sale price is fair and reasonable and the i

sale is in the best interest of the trust. -
WHEREFORE, Petitioner prays the court to authorize it
to comply with the terms, conditions and provisions of the ~
Sale and Purchase Agreement above mentioned, a copy of which ~ ~ ~

is attached hereto as Exhibit A, and to sell and convey the ~

property in accordance with the terms, conditions and pro- !

visions of said agreement; that the Petitioner is authorized Z

I to incur any such expenses and costs as are reasonably '

necessary to comply with the terms, conditions and provi-
~ sions of said agreement and to pay all real estate brokerage

~ commissions and/or consulting fees, and legal fees in con-

~ nection with negotiation of said agreement and the perform-
ance of the terms, conditions and provisions thereof. ~
