Motion for Sur.unary Judgment and the Court having entered an

~ Order on Motion for Summary Judgment dated 1?iay 31, 1977 and

~ It is hereby ORDERED and ADJUDGED:
~ 1. Section 193.461(4)(a)(4), Florida Statutes,

requiring the automatic non-agricultural reclassification
of a~l lands previously classified agricultural for which a
subdivision plat has been f iled after July 1, 1972, is
~ constitutionally deficient on its face and void.
