board. Plaintiii asserts that he is entitled to 3.5~ o~ all tbe
additional mechanical systeme work added wbea the 8chool Board
made the ~hange in air conditioning. As t4e mechanicsl syetema
work aas increased by some ~595,000.00 this arould give Plaintiff
$20,825.00 of the increased architectural fee of $20,920.00. This
aould be over 9?`X, of the total increase in architectural iee when
Plaintitf had theretofore agreed to do tbe mechanical ayatems work. ~
for 2'l'~ of- the total architectural fee. ~ This aould be an uncQn-
acionable tee division. It:is true that Flaintiff was called upon -
to do additional work not contemplated in the original agreement
between_tbe parties and he is entitled to payment therefor on a
quantum meruit basis takiag into consider.atlon Plaintiffs continuing
awareness of the fact t6at the architectural !ee in which he is to -
ehare was pegged on a"not to eaceed" basis by the School Board.
The Court finds from all the evideace that Plaintiff is entitled ~
to a basic fee from Defendants ot $45,500.00 plus a ~ee of $?,000.00
for additional services performe~d, for a total of ~52,500.00. The
~ Court feels that court oosts should not be awarded to either party
G and t6at each party should bear thei'r respective costs incurred.
