This cause came on before the court upon the Defendant, RESERVE
INSLTRANCE COMPANY, as insurers of the named Defendant, I~LVIN WOLKOWSRY,
M.D.'s 1~'f~tion to Set Aside/Amend Final Judgment; the be£eadant, UNITED
STATES FIDELITY ~ GUARANTY COMPANY's Motion for Set-Off and the ore tenus -
motion of the Defeadant, UNITED STATES FIDELITY ~ GUARANTY COI~ANY's Motion
for Equitable Distribution and the Court having reviewed the said Motions,
having hesrd the arguments of counsel, and being otherwise fully advised in
the premises, it is~thereupon
CONSIDERED, ORDERED and ADJUDGED:
1. That the Final Judgment in the original cause herein in an amount
of Forty-Nfne Thousand Five Hundred Dollars ($49,500.00) in favor of the
Plaintiffs and Final Judgment in an amount of Three Thousand Dollars ($3,000.00)
in favor of the Plaintiff, SANTO GIBILISCO, individuallq in a total gross amount
be apportioned between the Defendant, RESERVE INSURANCE COMPANY in an amount
of Forty-1~o Thousand Five Hundred Dollars ($42,500.00) and to the UNITED
STATES FIDELITY ~ GUARANTY COI+IPANY in an amount of Ten Thousand Dollars
($10,000.00).
2. That the De£endant, UNITED STATES FIDELITY & GUARANTY COI~ANY's
Motion for Set-Off and their ore tenus~Motion for Equitable Dfstribution as
subrogee of the Allstate Insurance Company to which the Defendant, UNITED
STATES FIDELITY ~ GUARANTY COI~ANY paid Five Thousand Dollars ($5,000.00) ~
for personal injury protection reimbursement to Allstate, it is granted to the
