This cause came on for hearing and the Court having heard
arguments of the respective counsel for the parties, concerning
the Motion for Continuance and Motion to Compel filed herein, and
the Court being apprised of the circumstances relative thereto,
upon consideration~, it is
ORDERED AND ADJUDGED as follows: -
1. That the Motion to Compel as filed by the defendant, DONALD
MOYANT, herein, be and it is hereby granted, and the plaintiff

j shall have ten days from the date hereof in which to comply.

~ 2. That the Mution for Continuance as filed by the plaintiff
herein, be and the same is hereby granted, and this cause shall be

set for jury trial without further motion being filed. The Court
herein, due to the delay of this matter occasioned through no fault
of the defendant herein, DONALD I~YANT, reserves an attorneys' fee
to be awarded to Gilbert and Horowitz, P. A., defendant's atCorneys,
for time spent on trial preparation prior Co the granting of this
continuance. It is further ORDERED that, based upon~the stipulation
announced by the plaintiff in open Court, no affidavits or testimony
need be presented to the Court for the awarding of such attorneys'
fees. ` -
