That the record on appeal discloses sufficient evidence to support the ~udgment.of the Court.below that the Appellgnt was negligent in failing to discover visible signs of live termite ; infestation in Appellees' home and liable for damages. k • ~ 2. That the three points raised on appeal by the Appellant ~ , are without merit. ~ . 3. That the point assigned by Appellee as a cross-~ assignment of error is w3thout merit.
