made for notice o~ any kind, it shall be dee~ed sufficient notice and
service thereof if such notice to Lessee is in writing, addressed to
~ Lessee at its last known address and sent by certified mail with
postage prepaid; and if such notice to Lessor is in writing. addressed
to the last known post office address of Lessor, and sent by certified
mail with postage prepaid.
35. CONSTRUCTION. This lease is to be construed in ac-
cordance with the aws o~ t e State of Florida.
36. CAPTION AND TITLES. The captions and titles contained
in this lease are or conven ence and reference only and in no way
define, limit or describe the scope or intent of this lease or any
part thereof nor in any way affect this lease.
- 37. SEVERABILITY. The invalidity in whole or in part of ~
any covenant, prom se or un ertaking or any section, subsection,
sentence, clause, phrase or work, or of any provision of this lease
or the Exhibits attached hereto. shall not affect the validity of
the remainin~ portions thereof._ .
38. PARTIES. The term "Lessor" and "Lessee" as used in
this lease shall n~clude the singular and plural thereof, and the
use of any gender shall include all genders, wherever the same shall
be appropriate, and shall include its successors and assigns.
39: RIGHT OF TERMINATION. Notwithstanding anything to the
contrary hereinbe ore set ort , t.e Lessee shall have an absolute
right to terminate this lease at any time after the expiratic~n of
one (1) year~upon the giving of thirty (30) days notice in writing.
to the Lessor of its intention to do so. In the further consideration
of this right the Lessee agrees to pay to the Lessor at the time it
notifies the Lessor of its intenti-on to so terminate a sum equal to
one-half (1/2) of the paid rental for the twelve (12) month period
immediately preceeding notification of the termination.
IN WITNESS WHEREOF, the parties hereto have caused this
instrument to be executed in their respective corporate names by
their respective duly authorized officers and their respective
corporate seals affixed this day of August, 1977. ,
