HomeMy WebLinkAbout0658 . ~ effectuating the purpose of this Trust Agreement, provided, haw- . ; ~ ever, that nothing 'shall relieve the Trusteea from liabilities ~ arising out of their awn misconduct, negligence or breach of trust. ; ~ (C) The Trustees shall not be liable for the acts ~ or omissions of any agents acting by or for them or the txust ; property where such appoint~ment was made with reasonable care. ~ (D) The Trustees shall have the follawing powers . F ~ and duties: (i) To hold title to the captioned ~ ~ ~ property during the tena of this trusteeship. : ~ . ~ (ii) To enter into Leases either on an ~ individual or group basi.s, on an exclusive or non- exclusive basis, covering all or a portion of the land ~ from time to time during the existence of this Trust with individuals, corporations and condominium corpora- tions that may be adjacent to ox near the property owned under this Trust. (iii) To sell all or a part of the land j. held under this Trust. The only appraval necessary ~ shall be one Trustee from each group appraving any , such sale. ~ ; ~ (iv) To borraw funds or to mortgage the ~ I • trust property, with the term of said mortgage, as well ` { as the interest rate, to be left to the sold discretion ~ ~ of the Trustees. ~ ~ f - 4 F (v) The Trustees are hereby granted the ~ i - authority to obtain such insurance as is deemed neces- ~ sary by the Trustees for the proper protection of the ~ Beneficiaries and the land, and are further granted the ~ right to pay the premiums therefor ancl shall be reim- bursed proportionately by the Beneficiaries upon request. (vi) The Trustees shall have the authority ' ~ to retain, employ and pay an attorney and counsellor at ; ~ law and a certified public accountant in connection with ~ the exercise of any pawers granted under this Trust # Agreement. ~ _ ~ (vii) The Trustees are hereby authorized to 4 ~ enter into Plats when so requested by joining with de- : ~ velopers; to make dec3ications of such roads and easements ; ~ that may be required by the adjacent developers in con- ~ ~ junction with their development of property being pur- ~ chased out of the trust property; and to exe~cute such ~ other documents as the Trustees, in their sole discretion, ~ ~ shall deem to the best interests and for the.ultimate f ~ benefit of all of the Beneficiaries hereunder. v d~ z~s ~ ~ s5~ ~ - 3 - CASSEL AND BE~JJAMIN, AT70RNcYS AT LAW.
