~ (iii) Finally, the remaining Funds, after
repayment of the original funds invested by the Bene-
f ic iaries and paym?ent to MART 7N NAFTAL and ALLAN
EASTOl~1 of their percentage for services rendered,
shall be divided anwng the Beneficiaries in propor- #
tion to their intexests as hereinafter set forth. ~

6. DEATH OF BENEFICIARY: The death of a Beneficiary

shall not act as a termination of this Trust Agreement, nor shall ;
such death entitle the legal representatives, heirs and distributeea s

of the deceased the right to claiun the termination of this Trust
Agreement, nor shall they be entitled to a prorata distribution of
the Tru9t property, nor shall they be entitled to take any act or
proceecZing to court for a partition thereof or for an accounting ~
of the property; and in the event.an action fs instituted for any
purpose, the cost of defending such action, together with (but
not limited to) reasonable attorney's fees in the defense of said
action, as shall be incurred by the Txustees hereunder, shall be
assumed by the legal representatives, heirs or distributees of the -
Beneficiary instituting said action. The legal representatives of
any Beneficiary would succeed to the interest of such Beneficiary
and would be entitled to all the rights arid liabilities as are
enjoyed or assutned in connection with the interest of said de-
ceased Beneficiary.
7. RES IC3TATI0l~TT OF TRUSTEE : A ma j ority of the
Beneficiaries in each group shall have the right to demand~the
resignation of a Trustee and to nominate a Successor-~rustee, to '
be accomplished by the execution of an instrument in a form re-
cordable under the laws of the State of Florida, which said instru-
ment shall include the followi.ng :
(A) Designation of the name and residence of the
Successor-Trustee, acceptance and assumption by said Successor-
Trustee of the terms and conditions, duties and responsi.bilities
