i 2. Enter on such lands with personnel, vehicles and
~I equipment for the purposes descrihed in 1 above;
:j 3. Remove from the right-of-way all trees and vegeta-
: tion that interfere with the purpose for which this right-of-way
~ is conveyed and released; .
i! 4. Take from the right-of-way and use earth, rock, sand
and gravel for the purpose of excavating, widening, deepening and
i~ otherwise rectifying the storm sewer system;

I! 5. Install, maintain or remove landscaping or other +
„ environmental improvements;

j! 6. Make all necessary earth fills; and

. 7. Locate or relocate existing drainage pipes or struc-
tures on Grantors' land lying outside such right-of-way, provided
that after.such fill and location or relocation is completed, ~

Grantee agrees to indemriify and hold Grantor harmless

'f of and from all injury, loss or damage of whatever nature, includ-~
ing counsel fees, arising out of the grant of this easement to ~
Grantee .
Grantor shall be permitted to tie into any and all
yt storm sewer installations in the easement area without payment of
any tap or connection fee to Grantee.

j~ Grantors agree not to further install, place or construc
or cause to be installed, placed or constructed any structures,
; within or over the above-described lands without the prior writteni
approval of the City, which consent shall not be unreasonably ;
withheld.
