ORDER
This cause coming on before the court on Motion to
~ Strike filed by Defendant, PLEASURE COVE MOBILE HoME PARK,
INC., and the ~iotions to Dismiss filed by Defendants,
PLEASURE COVE MOBILE HO~+iE PARR, INC., and Defendant, FLORIDA
EAST COAST RAILWAY COMPANY, and the court having heard
argument of counsel and being fully advised in the premises,
it is thereupon
ORDERED AND ADJUDGED as follows:
; 1. Defendant's motion to strike be and the same
~
is hereby granted.
. 2. The motions to dismiss filed by Defendant,
FLORIDA EAST COAST RAILWAY COMPANY and PLEASEURE COVE MOBILE
HOME PARK, INC. is granted as to Counts I and II of Plaintiff's
Complaint. Plaintiff is hereby granted leave to amend by
addemdum within ten (10) days of the date hereof.
3. Defendant's, PLEASURE COVE 'riOBILE HOME PARK,
INC., motion to dismiss as to Count III is hereby denied,
provided that the Defendant may reassert its motion as a

~ - motion for summary judgment or at pretrial conference.
Prior to that time, each party shall submit memorandums of
law on the issues of law raised in Count III of Plaintiff's
~ ,
