deed or either, ure not duly performed, complied with and.abided by the said aggre ate sum

8. The Mortgagee may, at any time while a auit is pending to forecloae or to reform this
mortgage or ta enfonce any claims arising hereunder, apply to the court hauing jurisdiction
thereoj for ihe appointment o~ a receiver, and sueh court shall forthwith appoint a receiuer of
the ~remises and all other property couered ieereoy, inciuaiR~ atf ~zr~d singular the income, prof
its, rents, issues and reuenues from whateuer sour~ce deriued, and such reeeiuer shaU haue all the
broad and ejfectiue functions and powers in anywise entrust~d by a court to a reeeiuer and such
appointment shall be made by such c~ourt as an admitted equiiy and a matter of a6solute right
to sacd Mortgagee, and without reference to the adequac or tnadequaey of the ualue of the prop-
er~y mongaged or to the solueney or insoluenc~y of sa~Mortgagor or the defendants, and such
income, pro~its, rents, issues and reuenues shall be applied by such reeeiuer according to the lien
of this mortgage and the ~rnctice oj such court. ~
