predecease me, I give and devise a11 of my estate, real, personal and
mixed, to my father-in-law and mother-in-law, MAX~NOVIE and FAY NOVIE,
or to the survivor of them, to be theirs absolutely and forever, or
in th~ event that both of them predecease me, then to DAVID KAPLAN,
RANDY KAPLAN and STEVEN KAPLAN, as tenants in common, share and share '
alike, to be theirs absolutely and forever, per stirpes and not per
capita.
NINTH: If any of the provisions of this Will or th~ Trust
contained herein shall be unenforceable or void the remaining pro-
visions shall nevertheless be carried into effect.
TENTH: I make, constitute and appoint my be2oved Wife,
ELAINE R. BERMAN, to be the personal representative of this my Last
Will And Testament. In the event that my dear Wife is unable or
unwilling to serve as personal representative, I make, constitute and

appoint my father-in-law and mother-in-law, MAX NOVIE and FAY NOVIE,
or the survivor of them as alternate personal representatives, or in
the event my said father-in-law and mother-in-law, are unable or
unwilling to serve or predecease me, I make, constitute and appoint
my beloved daughter, ALICE I. BROOMHALL, if she shall be eighteen
years of age or older at the date of my death and in the event that
she is not eighteen years of age or older, I make, constitute and
appoint my~dear sister-in-law, LAURA KAPLAN, as alternate personal
representative. I expressly confer upon my said Wife, alternate -
personal representatives or either of them, as personal representative,
the power to administer my estate without bond, without the necessity
or requirement of making any returns whatever to any Court, and with
full authority and power to encumber, mortgage, lease or to sell and
convey any part of my estate, real, personal or mixed, at public or
private sale, with or without notice as they may deem best, and with-
out ~he order of any Court. In the event, that my beloved Wife
