THIS CAUSE came on to be heard upon the Husband's Motion
for Modification and the parties having stipulated in open Court
that the child, FRANK R. SMITH, JR., shall be placed in the per-
manent care, custody and control of the Husband, FRANK R. SMITH,
SR., and that the Division of Family Services of the Department
of Health and Rehabilitative Services make an evaluation and con-

~ clusion as to the proper care and custody of the minor children,

; VALERIE L. SMITH and DAVID T. SMITH, it is thereupon
~
ORDERED AND ADJUDGED THAT:
' 1. The permanent care, custody and control of the minor child,
i
~ FRANK R. SMITR, JR.,.be and the same is hereby awarded to the Husband,
subject to reasonable visitation rights of the wife.
2. The Division of Family Services of the Department of Health f
and Rehabilitative Services of the State of Florida is instructed
~
to conduct a study of the parties to this cause and make an eval-
~
~ uation~and conclusion as to the permanent care and custody of the ~
G:
minor chi]dren, to wit: VALERIE L. SMITN and DAVID T. SMITH.

~ 3. This cause shall be continued until such time as the matter . '
~ is reset for trial by either party. ~
