Thfs cause having cane to be heard on the Ptaintiff's Motion for
SusnarY Final Judgment, and the Court being fully advised in the premises, it is
thereupon
ORDERED AND ADJUOGED as folla+s: -
1. That the Court has 3yrisdiction over this cause and the sub~ect
eatter and the parties. .
2. That the default 3udgments previously entered herein are ratified
and confinned.
3. That the mortgage hereir~ sued upon by the Plaintiff was legally
executed, acknowledged, delivered and recorded as is alleged in Plaintiff's
Coaplaint; that the Promissory Note thereby secured was also properly executed
and delivered; and that the Promissory Note and Mortgage Mere and do constftute
a vaiid and subsistinq lfen upon the real .property of the Defendant, WILLIAM
DUDLEY, ahich property is hereinafter described:
4. That the default in making the payvents of the principal and
interest upon the said note constitutes a breach of the covenants of the
Mortgage herein sued upon.
5. That the Defendants, CLIMATIC CORPORATION, MARY LOU PHILLIPS and
IIILLIAM DUDI.EY, have defaulted in making the payments of the principal and
lnterest upon the said Promissory Note and nour oNe the Plaintiff on account af the
principal and i_nterest on said Note and Mortgage, the sun of s~ /3~0. ~o.~
rrhich ffqure includes amounts paid by the Plaintif# on behalf of the Defendants,
late charges and interest accruing to the date of this Judgment, together with the
s~ of ~~'.ZDD .OD , Nhich is hereby awarded as attorneys' fees for the
~ services of the Piaintiff's attorneys herein, together Kith all costs of this suit
r+hich to date amount to SZ s~Z. 9.2 , and the Plaintiff is additionally entitled
to recover interest at the statutory rate of 6 percent per ann~n from the date
hereof to the date of sale.
