9. ~Sellers have estimated the fruit crop presently on the '

grove sold her~under approximates 33,900 standard boxes, estimated
by varieties as hereinafter set forth. ~ (
10. As an inducement to Buyer to enter~into this agreement,
Sellers quarantee to him that the amount of such boxes picked during
the current season will be not less than 33,900 boxes, unless the fruit j~
~
is damaged by weather or other hazard, including but not limited to
freeze, hail, drought, tornado, fire or hurricane. If it is so damaged, i'
the number of boxes lost shall be determined by the parties, and if
~
they are not able to agree, then shall be determined by such person as ~
~
they jointly shall select. If they fail to agree on such person, then ~
each of them shall~designate a person-and the two persons so designated +

shall select a third person, and the three persons shall make the re- ~
.
quired determination and shall resolve disputes by majority vote. If
ir
one of them designates his nominee and the other fails to dojso within
five days after written notice of such designation, then the single
person so designated shall act as sole arbitrator. The determination
made hereunder shall be conclusive and binding upon both parties. F

11. In the~event that there is a shortage in any one or more
of.the five said varieties, then the Sellers shall pay the Buyer for
such shortage at the prices hereinafter_set.forth, provided that there
shall be applied as a credit against any such'required payment the
amount received by him, if any, attributable to fruit in which there
is an overage, all at the prices hereina~fter set forth:
