THIS CAUSE was heard on Petitioner's applicat~on f~r -t-~

temporary relief based on her sworn Petition and~ppeariing to
the Court that the petitioner is entitled to a part of the
temporary relief demanded, without notice, that there exists
eminent danger of great harm to the Wife and the c?~ildren by the
Husband, that there have been many previous occurrences on which
the Husband inflicted bodily harm upon the Wife. that there have
been recent acts of violence by the Husband upon the Wife in
which the Husband choked the Wife and injured the Wife in the

~ chest area. That the Wife is without fimds V~ith which to post
~ a bond (all of the foregoing having been testified to by the Wife

after having been sworn by this Court), and that the acts of

? violence apprehended will be done unless relief is granted, it is

~ ORDERED AND ADJUDGED that:

° 1. The sole custody of the minor children, DAVID E.

~ SWARTZ, JR., age 15 and RUSSELL G. SWARTZ, age 11 is temporarily

r awarded to the Wife. -

= 2. The Wife is granted sole possession of the marital

dwellin~ located at 7601 Hibiscus Road, Lakewood Park, Fort Pierce,

Florida. The Husband, DAVID E. SWARTZ, is hereby enjoined and

restrained from coming about,molesting, harassing, harming or
;s annoying the Wife, BARBARA J. SWARTZ~ and their minor children,
- DAVID E. SWARTZ,JR. and~RUSSEL G. SWARTZ~ and the Husband is hereby
ordered and directed to remove himself and his personal effects
