FINAL JUDGMENT THIS CAUSE came on for trial after due notice to all parties on the 4th day of January, 1978, before the Court sitting without a jury, and the Plaintiff appeared with counsel, and a default having been entered against the Defendant for failing to file or serve an answer or other pleading,.and the Court having heard the testimony and having examined the proofs offered into evidence by Plaintiff, - and the Court being otherwise fully advised in the premises,finds the facts as follows: Findin~s of Facts l. That each and every allegation contained in Plaintiff's ~ Complaint is true. ~ 2. That Defendant was duly noticed for trial and served with ~ process as provided by law whereupon a defau~t was entered agairist her ~ for failing to file or serve a pleading as provided by law. t ~ ~ 3. That the prosecution of Plaintiff as alleged in the Complaint ~ on file herein has caused Plaintiff great physical inconvenience and E lo3s .~,s.r ~ ~ g discamfort, loss of time,~mental suffering, humiliation of mif~d, shame, ~ ~ ~ publi~c ridicule, invidious publicity, and public disgrace to his loss ~ ~ and damage in the sum of ~10,U00.00 as compensatory damages. ~ 4. That the Defendant commenced the prosecution complained of j with malice and without probable cause for the purpose of injuring Plaintiff in his reputation and credit and the Plaintiff is enti~led to exemplary or pur.itive damages in the sum of $1,000.00. ~ Conclusions of Law = From the foregoing facts, the Court concludes: 1.
