SUhw1ARY FINAL JUDGMENT IN FORECLOSURE This cause having come to be heard on the Plaintiff's Motion for Sumnary Final Judgment, and the Court being fully advised in the premises, it is thereupon ORDERED AND ADJUDGED as follows: 1. That the Court has jurisdiction over this cause and the subject matter and the parties. - 2. That the default judgments previously entered herein are ratified and confirmed. 3, That the mortgage herein sued upon by the Plaintiff was legally ~ executed, acknowledged, delivered and recorded as is alleged in Plaintiff's Complaint; that the Promissory Note thereby secured was also properly executed and delivered; and that the Promissory Note and Mortgage were anddo constitute ~ a valid and subsisting lien upon the real property of the Defendants, THOMAS ~ ~ JESS PHILLIPS and MARY LOU PHILLIPS, his wife, which property is hereinafter ~ 3 ~ described. ; : ~ 4. That the default in making the payments of the principal and ~ E; interest upon the said note constitutes a breach of the covenants of the ~ Mortgage herein sued upon. ~ 5. That the Defendants, THOMAS JESS PHILLIPS and MARY LOU PHILLIPS, ~ have defaulted in making the payments of the principal and interest upon the said Y ~ Promissory Note and now owe the Plaintiff on account of the principal and interest y on said Note and Mortgage, the sum of which figure includ~s ~ ~ amounts paid by the Plaintiff on behalf of the Defendan~s, lat~ charges and ' interest accruing to the date of this Judgment, together with the sum of $ SOO.~'O- ;l which is hereby awarded as attorneys' fees for the services of the Plaintiff's = attorneys herein, together with all costs of this suit which to date amount to - ~~3I.~`'~, and the Plaintiff is additionally entitled to recover interest at the = statutory rate of 6 percent per annum from the date hereof to the date of sale. - g~ ~ t'M~t ~ - . . _ y
