Plaintiff has a valid first lien upon the said mortgaged property situated,
lying and being in the county of St. Lucie, the State of Florida, being more
particularly described as follows: ~
Lot 4, Block 17, RIVER PARK, UNIT 2, according
to a plat thereof on file in Plat Book 10, Page 72, of
the Public Records of St. Lucie County, Florida.
7. If the total sum with interest at the rate prescribed by law and
all costs of this action accruing subsequent to~this judgment are not paid,
the Clerk of this Court shall sell the property at Public Sale to the highest
bidder for cash, free, clear and discharged of and from any and all cla3ms, liens,
encumbrances, rights and equity in interest of the said Defendants, THOMAS JESS
PHILLIPS and MARY LOU PHILLIPS, his wife, which sale shall be held by the Clerk
of this Court on , the ~ day of , 1978, at oo a.m.
at the ~ Front Door of the St. Lucie County Courthouse in Fort Pierce,
Florida, in accordance with F.S. 45.031. ~
8. Plaintiff shall advance all subsequent costs of this action and
` shall be reimbursed for them by the Clerk if the Plaintiff is not the purchaser
of the property at the sale. If the Plaintiff is the purchaser, the Clerk shall

~ credit the Plaintiff's bid witR the total sum with interest and costs accruing

~ subsequent to this judgment or such part of it as is necessary to pay the bid in

` full.
~ 9. The Court makes no findings herein as to the validity of the claims,

~ liens or encumbrances asserted against the above-described real property by any

A and all named Defendants herein, except that the same are hereby found to be

~ inferior to the above-described mortgage lien of the Plaintiff herein; th~t in the
~
- event the above-described property is sold at Public Sale as specified above, it
~
~
shall be sold free and clear of any claim, lien or encumbrance of any Defendants
~
herein, except any right of redemption which may be afforded to the Defendant,

UNITED STATES OF AMERICA, pursuant to 28 U.S.C. 2410 {C);and that if any proceeds
~
of said sale remain after application of the proceeds as set forth herein, such
remaining sums shall be deposited with the Registry of the Court which it will be
~
~ available for disbursement to the Defendants herein after this~Court determines
validity and priority of the claims, liens and encumbrances of all Defendants herein.

10. Upon receipt of the purchase price paid at said sale, the Clerk shall
- issue a Certificate of Sale, and if no objections to said sale be filed within the
- time required by law, said Clerk shall issue his Certificate of Title and Certificate
