BEFORE ME, the undersigned authority, this day per-
sonally appeared DALE L. HARMESON who after being duly sworn
did depose and say:
I. He is Manager of the Fort Pierce, Florida office
of Abstract and Title Corporation of Florida and as such he
has personal knowledge o£ the facts herein alleged.
2. Because of the large volume of transactions and
recordings handled through the Fort Pierce office of Abstract ;
and Title Corporation of Florida, standard phrases are used ;
on ce~tain instruments, including warranty deeds of conveyance.
3. Standard phrases were used by him in preparation
of two deeds from Marion M. McDowell and Mary S. McDowell
reciting the grantors to be husband and wife. Said~deeds are
recorded in Official Record Book 236, at page Y010 and page
1011, public records of St. Lucie County, Florida.
4. The recitals of marital status inserted in said
deeds at the time of their preparation were erroneous, affiant
having~since learned that at the time of preparation of the
said deeds by him, said grantors were divorced from each other
and were both single adults.
5. The property referred to above, conveyed by said
deeds, was, at the time of conveyance, vacant and unoccupied,
and affiant has personal knowledge that both grantors resided
away from Fort Pierce and that the above described real property
was not the homestead of either of~the grantors.
