in any one year exceed the highest lawful rate of interest i~ the State of Florida.
This Note is secured by a mortgage (the Mortgage) , dated the date hereof,
of property situated in the State of Florida, granted by the Maker to the Payee, to
which reference is hereby made for a descriptio~ of ~the mortgaged property, the
nature and extent of the security, the rights of the Payee jn respect thereof and
!he terms and conditions upon which this Note is issued.
The Maker agrees that it shall be bound by any agreement extending the
time or modifyi~g the above terms of payment, rr~ade by the Payee and the owner
or owners of the property affected by the Mortgage, whether with or without
notice to the Maker, and the Maker shall conllnue Ijable to pay the amount due
her.eunder, but with interest at a rate ~o greater than the Interest Rate, acoor-
ding to terms of any such agreemeni of extension or modiflcation.
The unpaid balance of the Prlncipal Amount, plus accrued interest shali
become due and payable at the option of the Payee ~der the happening of an
event by which said balance shall or may beaome due and payable under the terms
of. the Mortgage .
This Note may not be changed orally, but only by an agreement in writing,
signed by the party against whom enforcement of any waiver, ch~nge, modi-
fication or discharge is sought.
All parties to this Nole, whether Maker, principat, surety, guarantor or
endorser, hereby waive presenbnent for payment, demand, protest, notice of
protest, and notice of djshonor, and expressly agree jointiy and severally to
remain and conti~ue bound for the payment of the principal and interest provided
for by the terms of this Note, notwithstanding any extension or extensions of
ihe tirrte of, or for the payment of said principal or interest, or any change or
changes in the amount or amounts agreed to be paid under or by virtue of the
obligation to pay provided for i~ this Note, or any change or changes by way ~
. of release or surrender or substltution of any real property and collateral, or
eiiher, held as security for this Note, and waive all and every kind of notice of
such extension or extensians, change or changes, and agree that the same
may be made without the joinder of the Maker, -
