ORDER and NOTICE OF HEARING
This matter coming on the motion of the Plaintiff for the
ex parte appointment of a Receiver, and the granting of a temporary
injunction, and for the scheduling of a hearing for further con- ~
sideration of same, and this Court having read the verified Complaint
and Affidavit filed by the Plaintiff, and it appearing therefrom that
facts exist requiring the appointment of a Receiver for the property
described in the Complaint;Now on riotion of the attorney for the _
Plaintiff, it is ordered and adjudged as follc=iws:
` 1. That the defenclants appear before this Court on the 15th day
of February 1978 at 9:~0 a.m., and show cause if any they may have
why a Receiver should not be appointed as prayed for in the Plaintiff's
Complaint.
2. That pending the hearing on said Order to Show Cause that Pat
Hughes be and she is hereby appointed as temporary Receiver herein to
take possession of the property located at 3343 South Federal Highway,
Fort Pierce, Florida of the business being operated as a wholesale
grocery and meat business owned and operated by the defendants, together
with his goods, effect and bank accounts, and she is to collect the debts
due it and preserve and dispose of same under direction of the Court
until further order of this Court.
3. It is further ordered and adjudged the Defendants, SMIFAM
WHOLESALE, INC., JAMES H. SMITH and MARION H. SMI~'N are enjoined and
restrained £rom selling or disposing of any of the assets of the
business, from collecting or receiving the firms debts, and from
