1. That the oral stipulation and the written instrument
representing it beinq reduced to writinq are expressly incorporated
into and made a part of this Order and all parties are ordered to
comply therewith. Said oral stipu2ation and written instrument
shall survive the dismissal of this action and shall be binding upon
all parties thereto. ~
2. Tha~ the Clerk of this Court be and he is hereby
ordered forthwith to pay the sum of $5,000.00 to FREDRIC HENSEL, SR.,
from the fund deposited by him under the bond executed on February 1, _
1978, and the Clerk of this Court is further ordered to cancel said
bond of record.
3. That the above styled cause is dismissed with prejudice
and the Plaintiff and Defendant shall each pay their own respective
costs of suit and attorneys fees.
4. That the order rendered by this court in this cause on
February 1, 1978, is vacated and shall be null and void upon the
rendition of this Order.
5. That the injunction rendered against the Defendants,
SMIFAM WHOLESALE, INC „ JAMES H. SMITA and MARION SMITH on February 1,
1978, is dissolved and vacated. _
6. That the resignation of PATRICIA HUGHES as temporary
receiver shall be and is hereby accepted by this Court and she is t
hereby discharged from the office of temporary receiver in this action
and she is further discharged from any further duty and office as
such temporary receiver. That said temporary receiver is~ordered to

transfer the respective properties of the meat and grocery divisions ~
