4. Pending the sale of the property~ the Husband may ;
remain in possession of same providing rhat he make all mortgage, j
tax, insurance, and all other reasonable and necessary payments ~

to maintain the property and he further agrees to maintain the ;

property in such condition that it will be attractive to poten- ~
tial buyers and inspecting realtors. j j

5. The Husband agrees to allow the Wife to inspect ~
said property to ensure ~hat it is in the condition stated above,
but requires reasonable notice of her intention to perform said
~
inspection.

6. The Husband acknowledges that he has failed to 3
make certain mortgage payments on said property during his ~
~
occupancy of the home located thereon subsequent to the entry ~
of the Final Judgment heretofore mentioned. For this reason, ~
he agrees to reimburse the Wife out of his proceeds upon the
sale of the property and further agrees to reimburse her in ~ f
- ~
the same manner for any payments which she might be required ~
,
to make pend~ng sale. }

7. Upon the sale and closing on the same, the proceeds ;
will be evenly divided between the parties subject to the Wife's
' ~
reimbursement as stated above. ;

8. The Husband agrees that if he fails to abide by ~

any of tr.e foregoing provisions he will immediately vacate the
home and each party will thereafter pay half of all the expenses
until the property is sold.

9. The parties acknowledge that certain joint obliga- a

. tions existed at the date of entry of the Final Judgment herein ~
a
and agree that each will pay half of said obligations with the
exception of the money owed to Sears which the Husband agrees ~ ~y
to pay and frc~m which he agrees to hold the Wife harmless. ~ ~

10. The parties acknowledge that all personal property ~
