The parties agree that the payment or lump sum alimony is a vested right in the Wife and that such right survives the Husband's death and is an obligation of the Husband or his estate until paid in full. The parties . further recognize that the amount of agreed lump sum alimony is not in any manner contingent upon subsequent-events and is not subject to modification in any r.ianner for any reason. , 21. The parties have heretofore filed certain joint ' income tax returns and covenant to file a joint tax return for 1976. The parties agree that the Husband shall pay all taxes due on said.return. The Husband shall and by these presents does inde~tnify and hold the Wife harmless from any loss, cost, claim, damage or expense, including counsel fees and accountant fees, which might arise out of any of the joint income tax returns filed by the parties, including the 1976 return, and any deficiency assessment in connection therewith. If there is any refund on any of ~ the aforesaid returns, same shall belong to the Husband. 22. The Husband agrees to pay the tuition for the minor children of the parties during the period of time they are ~ enrolled in a Catholic school and shall pay for.all books and transportation expenses incidental thereto. In addition, the Husbarid agrees that if any of ~the r.iinor children have the capabilities and can gain admission to any college or university, he shall be responsible for all tuition, books, and expenses incidental thereto until such time as any of the minor children graduate from said college or university, provided that the children are in good standing at said college or university.
