PROVIDED ALWAYS, That if said Mortgagor, his heirs,
legal representatives or assigns, shall pay unto the said
Mortgagee, its legal representatives or assigns, a certain
promissory note dated the 26th day of December, A.D. 1973, and
modified the lst day of June, A.D. 1976 for the sum of
Twenty-five Thousand Dollars ($25,000.00) payable Five Thousand
Dollars ($5,000.00) annually with interest quarterly at Ten
Per Cent (10$) and having a principal balance of Nine Thousand
Five Hundred Twenty-one Dollars and 29/100 (59,521.29) as of
this dat~ from PATRICK B. LALLY and JUDY LALLY, his wife, signed
by PATRICK B. LALLY and JUDY LALLY, and shall pay all sums payable
by PATRICK B. LALLY and JUDY LALLY, and shall pay all sums payable
hereunder, and perform comply with and abide by each and_every the
stipulations, agreements, conditions and covenants of said promissory

"note and of this mortgage, and shall duly pay all taxes, and also
insurance premiums reasonably required, and all costs and expenses
including a reasonable attorney's fee, which said riortgagee ma_y
incur in collecting money secured by this mortgage, and also in
enforcing this mortgage by suit or otherwise, then this mortgage
and the~estate hereby created shall cease and be null and void.
