Ceneral Druinage and Overflo~v Easement

Crantor reserves to itself anci its successors, a general ancl
perpetual easement extending tilX'OUCJ~IOUt the lands conveyed hereby
to drain, discharge~and overflow surface waters from lands retained
by Grantor for the pt~rpose of m~intaining historic hyclroflows in
and to the lands convcyed hereby or as required by existing and
future regulations and laws of local, state or fecleral governmental
bodies and a~gencies having jurisdiction over Grantor•s retained
lan~ or over the lands conveyed hereby.
Restrictions ~ ~ .
. This deed is executed subject to the follo~ainh specific
restrictions ~vhich shall be binding upon the Grantee, it~ successors
and ass=gns, except as specifically provided in Paragrapr,~~ 2 and 3
hereof :
l. There shall not be permitted on the subject properties:
a. Any dredging or dredge spoi dumping.
b. Any construction of roads, powerlines or gaslines.
c. Any artificial drainage or.impoundments.
d. 11ny domestic livestock graziny.
e. Any farming or related agricultural activities.
f. Any land clearing.
g. Any dumping or disposal of waste materials.
h. Any mining or drilling for oil or gas.
i. Any pesticide or herbicide spraying.

j. Any use of motorized vehicles on land or water except for
~ emergencies or valid manayement purposes.

E K. Any removal of timber or cutting of native vegetation,
~ except to restore original plant communities.

~ 2. a. The foregoing use restrictions shall not work to prevent
full enjoyment by the grantor or its successors of any and all
rights and easements reserved to the Grantor herein; and, to
the extent necessary to permit the Grantor or its successors
to meet express requirements of environmental regulation and
other agencies with appropriate jurisdiction in the full enjoy-
~ment of the righCs and easements reserved h~rein, the foregoing
~ use restrictions shall be automatically waived.
~ b. Nothing in the f~regoiny use restrictions shall prevent the
Party of_ the Second Part or its successors from taking such
~ reasonable actions as it deems necessary in ~he event of an
~ emergency affectinc~ the public ~~el£are. tlor shall anything in
