- This cause came on to be heard, after due notice, on
plaintiff's Motion for Summary Judgment in Foreclosure against
defendants Ft. Pierce Construction Corp., Realty Holding Corp.,

- and Kurt Hi].ler, last director of Simgo Corporation, a dissolved
- ~
corporation, upon the Complaint of plaintiff to foreclose a
mortgage. The Court finds, based upon the evidence offered in
~
support of such Complaint, upon the answers and stipulation of
defendants, and the arguments of counsel, that there is no

I genuine issue as to any material fact and that the plaintiff is '

; entitled to a Sum~nary Judgment against said defendants. The
~ Court being otherwise duly advised in_the premises, it is • . ~

1. Due and legal service of process has been had upon
the defendants; this Court ha~s jurisdiction of the parties in this
cause and its subject matter; the defaults entered herein against
. defendants Realty Hold~ng Corp. and Kurt Hiller, as last director
~ of Simgo Corporation, are ratified and confirmed; the allegations
~ ;

~ contained in ~he Complaint have been proved by competent evidence ~
and~the equities in this cause are with the plaintiff; there is ~

no genuine issue as to any material fact; and plaintiff is
