THIS CAUSE came on to be heard before the Court on the
Motion of the Defendant, PEOPLES FEDERAL SAVINGS AND LOAN, to dismiss ;
this cause as to said Defendant. Both parties were represented by
Counsel, and upon argument of counsel and being fully advised in
the premises, it is
~ ORDERED AND ADJUDGED that the Complaint filed herein be
and hereby is dismissed as to Count III thereof and the Defendant, {

PEOPLES FEDERAL SAVINGS AND LOAN, and it is further -
ORDERED that the Plaintiff, SIMBO BUILDING SUPPLY, INC.,
~ has fifteen (15) days from the date of this Order to amend its ~
Complaint filed herein. ,
