this Note shall be due and payabte. The total interest payable hereunder shall not
in any one year exceed the htghest lawful rate of inierest in the State of Florida,
This Note is secured by a mortgage (the Morigage) , dated the date hereof,
of property situated in the Ststa of Florida, granted by the Maker to the Payee, t~o
which reference is hereby made for a descriptior~ of the mortgaged property, the
r~ature a~d extent of the security, the rights of the Payee 1n respect thereof ar~d
the tarms and conditio~s ~ which this Note ~s lssued. -
The Maker agrees thst it shall be bound by any agreement extending the
time or modifyi~g the above terms of paymettt, made by the Payee and the owner
or owners of the property affected by the Mortgage, whether with or without
notice to the Maker, and the Maker shall continue liable to pay the amou~t due
hereunder, but with interast at s rate no greater than the ~Interest Rate, acoor-
ding to terms of any such agreemer~t of exte~slon or modification.
The unpaid baiance of the Principal Amount, pius~accrued interest shall -
become due and payable at the option of the Payee ~der the happening of an
eve~t by which said balance shall or may beoome due and payable under the terms
of the Mortgage .
This Note may not.be changed orally, but only by an agreement in writing,
signed by the pa~-ty against whan enforcement of any waiver, ch~nge, modi- '
fication or discharge is sought.
All parties to this Note, whether Maker, principai, surety, guarantor or .
endorser, hereby waive presentrner~t for payment, demand, protest, notice of
protest, and notice of dishonor, and expressiy agree jointly and severally to
r~emain a~d continue bound for the payment of the principal and interest provided
for by the terms of this Note, notwithstanding any extension or extensions of
. the time of, or for the payrr~eni of sald principal or interest, or any change or
changes in the amount or amounts egreed to be paid under or by virtue of the
obligation to pay provided for jn this Note, or any change or changes by way
of release or surrender or substitution of any real property and oollateral, or
either, hefd as security for ihis Note, and waive all and every kind of notice of
such extension or eociensions, change or changes, and egree that the same
may be made without the joinder of the Maker.
