SUMMARY FINAL JUDGMENT IN FORECLOSURE
This cause came on to be heard, after due notice, on .
plaintiff's Motion for Sw~nary Judgment in Foreclosure against
defendants Ft. Pierce Construction Corp.,-Realty Holding Corp.,
and Kurt Hiller, last director of Simgo Corporation, a dissolved
corporation, upon the Complaint of plaintiff to foreclose a
mortgage. The Court finds, based upon the evidence offered in
support of such Complaint, upon the answers and stipulation of
defendants, and the arguments of counsel, that there is no genuine
issue as to any material fact and that the plaintiff is entitled
to a Summary Judgment against said defendants. The Court being
otherwise duly advised in the premises, it is thereupon:
ORDERED, ADJUDGED AND DIRECTED THAT:
Z. Due and leqal service of process has been had upon
the defendants; this Court has jurisdiction of the parties in this
-'3 cause and its subject matter; the defaults entere$ herein against
defendants Realty Holding Corp. and Kurt Hiller, as Zast director
of Simgo Corporation, are ratified and confirmed; the allegations
contained in the Complaint have been proved by competent evidence
and the equities in this cause are with the plaintiff; there is no
genuine issue as to any material fact; and p2aintiff is entitZed
to a judgment as a matter of law.
