ORD~R ON CONTEMPT MOTION
This cause came on for hearing upon motion of the
Plaintiff, Department of Revenue, for entry of an order holding
the Defendant, W.E. Teschner, d/b/a Ocean View Apartments, in
contempt of this Court's Final Summary Judgment entered on
November 3, 1977, and the Court being fully advised in the
premises does hereby find:
- 1. That on i~overaber 3, 1977, this Court entered a
, Final Summary Judgment which provided in pertinent part:

j That this judgment shall hereby act as }

~ a mandatory judgment requiring said
; W.E. Teschner, d/b/a Ocean View Apartments,
~ to submit all books, records and accounts .
~ pertaining to the facility known as Ocean
~ View Apartments for inspection and audit by . -
~ the Department of Revenue upon reasonable
~ notice and at a reasonable time at the
~ business premises, S11 South Ocean View
Drive, Fort Pierce, Florida.
~ 2. That despite~repeated requests by Plaintiff, this

~ Court's Final Summary Judgment and, in particular, the afore- '
~ mentioned paragraph, have not been complied with by Defendant. ~
~ It appearing that ~efendant does have books, records and accounts

pertaining to the facility known as Ocean View Apartments and _
~ good cause not having been shown for failure to produce those :
