MODIFICATION OF FINAL JUDGMEiIT
This cause having come on to be heard before me on April 25,
1978, upon the Petition of the Husband, NERBERT E. YAIICY, JR.,
for a modification of this Court's Final Judgment of Dissolution
of Marriage entered in this cause on June 26~ 1974, and this Court
having considered the Petition for Modification, the Wife's
Counter-Petition for Modification, the evidence presented at the
trial, the Stipulation of the parties entered into evidence, and
the report of the Department of Health and Rehabilitative Services,
filed herein, this Court being otherwise fully advised in the
premises, it is upon consideration the finding of this Court that
it has jurisdiction over the subject matter and over the parties,
and there exists a substantial reason for a madification of the
final decree of this Court dated June 26, 1974. It is therefore
upon consideration
ORDERED AND ADJUDGED that the Court`s decree dated June 26,
1974, be and the same is hereby modified in part to read that
the Husband, HERBERT E. YANCY, JR., shall have the permanent
care, custody, and control of the minor child of the parties,
BRION D. YANCY, with reasonable visitation rights reserved to the
Wife, PENNY GORE~ f/k/a PENNY K. YAI~ICY. The Husband, HERBERT E.
YANCY, JR., shall and is hereby relieved from ~the paytuent of
child support to the Wife, PENNY K. YANCY, from the date o~ this
Order, as long as he has the permanent care, custody, and control
of BRION D. YANCY. All other provisions of this Court's decree
