This cause came on t~ ~e heard on the C~€~nd~nt, FQRm P:ERCE
CAB COMPANY'S~Motion to Dismiss and/or Motion to Abate and this
Court being fully advised in the premises, it is thereupon
ORDERED AND ADJUDGED that the Complaint of the Plaintiffs,
FRANR RORCE and MARY KORCE, his wife, is dismissed as to the Defendant,
FOR~ PIERCE CAB COI~PHNY, for failure to allege sufficient ultimate
facts to establish the relationship between the driver of the taxi
cab and the corporate Defendant, as owner of the taxi cab.
It is further Ordered that.the Plaintiffs, FRANK KORCE and MARY
KORCE, his wife, shall have ten (10) days within which to amend the
Complaint by addendum.
DONE AND ORDERED at Fort Pierce, St. Lucie County, Florida,
