HomeMy WebLinkAbout0700 ~ prior to eotry of a judgment enforcing this Mortgage if: (a) Borrower pays l.ende~ all sums which would be then due under this Mongage, the Note and notes securing Future Advanca, if any. had no acceleration occurred; (b) Borrower cura all breaches of any othe~ covena~ts or agreements of Borrower contained in this Mongage; (c) Borrower pays all rcasonable expenses incurrod by Leader in enforcing ~he rnvenaqts and agreements of Borrower contained in this Mortgage and in enforcing Lende~ a remedies as provided in paragraph 18 hereof, including, but ~ot limitod to, reasonable attorney's fces: and (d) Bonower takes such action as i.ender may reasonably rcquirc to assurc that the lien of this Mortgage, Lender's interat in the Property and Borrower's abligation to pay the sums securcd by this Mortgage shatl co~tinue unimpaired. Upon such payment and cure by Borcower. this Mortgage a~ the obligations secured hercby shall remain in full force and eftect as if no accekration had occurred. 20. Ass~ameaf ot Reat~ Appointmeat of Receiver. As additional security hereunder. Borrower hereby assigns to l.ender the rents of the Propeny. provided that Borrower shall, prior to accetcration under paragraph 18 hercof or abandoo- ment of the Property, have the right to collect and rotain such oents u tl~ey become due and payable. Upon acceleration under paragraph 18 heroof or abandonment of the Prope~ty, Lender shall be entitlod to have a receiver appointed by a court to enter upon, take possession of and manage the Property and to collect the rcnts of ihe ; Propeny, including those past due. All rents collected by the receiver shall be applied first to payment of the costs of management of the Propeny and collection of rents, including, but not limited to, receiver's fees, premiums on receiver's bonds and reasonabk attorney's fees, and then to the sums secured by this Mortgage. The nceiver shall be liable to account ' only for tlws~ rents actually received. 21. Fnture Ad~asces. Upo~ request by Borrower, l.ender, at l.ender s option within twenty years from the date of this Mortgage, may make Future Advances to Borrower. Such Future Advances, with interest thercon, shall be secured by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. At no time shall the principal amounl of the indebtedness secured by this Mortgage, not iocluding sums advanced in accordance herewith to protect the security of this Mortgage, exceed ihe original amou~t ot the Note plus USS.- - ~ - - ~ - - - - ~ - 22. Rdease. Upan payment of all sums securcd by this Mortgage, Lender shall reles~se this Mortgage without charge to Borrower. BoROwer shall pay all costs of recordation, if any. ~ 23. Attorney's Fees.
