HomeMy WebLinkAbout0706 ' - ~ prior to entry of a judgme~t enforcing this Mortgage if: (a) Borrower pays Lender all sums which wouid be then due under this Mo~tgage, the Note and notes securing Future Advances, if any, had no acceleration occurred; (b) Borrower curcs all breaches of any other covenants or agreements ot Borrower cootained in this Mongage; (c) Borrowe~ pays all rcasonable - expenses incurred by Lender in enforcing the covenagts and agrcements of Borrower contained in this Mortgage and in enforcing Lender's rcmedies u providcd in paragraph 18 hercof. including. but nat limited to, reasonable attorney's foes; and (d) Borcower taka such action as I,ender may reasonably rcquire to assure that the lien of this Mortgage. Lender's interat in the Property and Borrower's obligation to pay the sums secured by this Mortgage shall continue unimpaircd. Upon such payment and cure by Bomower, this Mortgage and the obligations secured hereby shall rcmain in full force and efFect as if no acceleration had oceurred. 20. As additional security hereuncler, Borrower hereby assigns to Lender the rcnts of the Propeny. provided that Borrower shall, prior to acceleration under paragraph 18 hercof or abandon- j ment of the Property, have the right to collect ar~d retain such rents u tbey become due and payabte. Upon acceleration under paragraph 18 hereof or abandonmeot of the Property, Lender shall be entitlod to have a receiver appointod by a court to enter upon. take possession of and manage the Property and to collect the rents of the P~openy. including those past due. All rents collected by the receiver shall be appliod first to payment of the coats of ~ management of the Property and collection of rents, including, but not limited to, receiver's fees, premiums on receiver's bonds and reasonable attorney's fces, and ihen to the sums secured by this Mortgage. 71~e receiver shall be liable to account only for those nnts actually received. 21. Future Ad~ances. Upon request by Borrower, I.ender, at Lender's option within twenty years from the date of this Mortgage. may make Future Advances to Borrower. Such Future Advances, with interat thereon, shall be secured by this Mongage when evidencod by promissory notes stating that said notes are secured hereby. At no time shall the principal amount of the indebtedness s~curcd by this Mortgage, not including sums advanced in axordance hercwith to protect thc securiry of this.Mortgage. excced the original amount of the Note plus USf 22. Rekase. Upc~n payment of aU sums secured by this Mortgage, Lender shall release this Mongage without charge ~ to Borrower. Borrower shall pay all costs of. recordation, if any. 23. Attoroey's Rees.
