THIS CAUSE came on to be heard on April 24, 1978, ~
upon all pending motions. The attorneys for the parties con-
ferred prior to .the hearing, and stipulated for the entry of
the following Order. It is, thereupon
ORDERED AND ADJUDGED as follows:
1) The plaintiff's Motion to Dismiss Counterclaim
previously filed herein by the defendant be, and the same is
hereby granted, and the defendant shall have twenty (20) days
from the date of this Order within which to file an Amended
Counterclaim if it so desires.
2) The plaintiff may file a Third Party Complaint
herein within thirty.(30) days of the date of this Order, or ten
(10) days after receipt of any Amended Counterclaim filed by the
defendant, whichever occurs first.

3) The plaintiff's oral Motion to Compel Discovery
is hereby granted, and the defendant shall have thirty (30) days
from the date of this Order within which to answer the inter-
-rogatories served upon it by the plaintiff on November 29, 1977,
and within which to furnish the plaintiff the doc~.m~ents and
discovery that the defendant's president, Vincent Gorham, stated
at the taking of his deposition on December 15, 1977, he
would voluntarily provide and has not provided to date, specificall,y
those documents enumerated in the Zetter of Dec.21,1977,from his
