THIS CAUSE having come before the Court upon the
~Defendant's Motion to Dismiss and To Strike, and the Court
having considered said Motions and the Complaint filed by the
'Plaintiffs, and having heard the argument of counsel, and
being otherwise fully advised in the nremises, it is hereby
ORDERED AND ADJUDGED that:
(a) The Defendant's Motion to Dismiss is hereby
'denied, the Court finding that a cause of action is stated.
(b) The Motion to Stirke is granted, in that the
~ Court finds that the~matters relating to punitive damages and

~ any settlement negotiations or attempts to settle are not proper

~ matters to be alleged in this cause. The allegations for

~ consequential damages may remain. .
