CCMMON EXPENSE AND COMMCN SURPLUS ~ . ~ . ; The common expenses of the Condominium, includinq the obl igation ; of each Unit Cwner under the Management Agreement attached to this ~ Declara.tion, shall be shared by the Unit Cwr~ers, as specified and set ~ forth in the Exhibits. The foregcinq ra.tio of~ sharinq common expenses and ~ assessments shall remain, rega.rdle~s of the purchase price_ of the ~ Condominium Parcels or Interval G~vnerships, their location or the ~ building square footage included in each Condominium unit. A ny common surplus of the A ssociation shail be owned by_ eacn of the Unit G~vners in the same proportion as their Qercentage ou?nership . interest in the commor~ elements (or, in the case of an Intervat - Cwner, his remainder interest in the common elements). ~ VII. 1~~AINTENANCE FEE FCR UNITS CCMMITTEL~ TC INTERVAL ; CWNERSHIP s ~ Each owner of Unit Weeks in Pa.rcels committed to Interva.l ~ G~vnership shall pay a"maintenance fee", which shail be in addition to . his prorata share of the ~ommon expenses. The maintenance fee shall include the Interval Owner's share of the following exoenses: (1) Repair and upkeep of alI parcel~ committed to Interva.l ~vnership from normal wear and tear (exampie- re~.inting interior wa11s); and j3nitorial 3nd custodial ~ ~ service.. , . ~ ~ (2)' Repair and replacement af furniture, fixtures, aoplia.nces, ~ carpetinq and utensils in all pa.rcets ~ommitted to interval owne rship. ~ ; ~ (3) Casualty 3nd/or liability insurance on a11 parcei~ ~ committed to interval owner~hip. ~ } (4) Personal property, rea,l estate and any other applicable taxes on the parcel nwhich he owns an interva.l ownership. ~ . - ~ ~(5) Anq and all other expense~ incurred in the normal ~ operation and m3intenance of the ~rcels committed to interval ownership which ^annot be attributed tc a particuiar Interval Cwner and whi~h are not common expenses. ~ The Interval Cwner's utility charges for utilities for hi~ U nit fo r his U nit Weeks. ' , ~ Each Interva.l G~vner s share of items (1), (2), (3) and (5) above, ~hatl be detertrined by dividing the total ~osts for these items for all p~.rce ~ committed to interval ownershi~ by the btal numbe* of Unit Weeks in pc~rcels committed to interval ownership, and then multiplying ~aid amount by the num ber o f U nit Weeks in ~tha.t pa rticula r Inte rval Cwne r's Inte rvat ~ Cwnership. Each Interval Cwner's share of item (4) shall be determineci = by dividing the charge applicable to his parcel by fifty-two (52) 3nd multiplying that amount by the number of Unit Weeks in his Interval ' Cwnership.
