XVIIII. USE CF CCMMCN EL EMENTS A NL` FA CIL ITIES ~

Th,e Condominium Association, the Unit G~vners, the reveloper 3nd
the respective heirs, successors and assiqns of all, and alI parties who ~wn
an interest in and to the 3foresaid facilities shall have no right to bring any 4
action for partition or division of the real property that constitutes said
facilities_and said parties do hereby waive said rigtits of pa.rtition or division ;
of said facilities. The initial Rules and Regulations, and all amendments ;
thereof and revision thereof pertaininq to use of the common elements and }
facilities shall be posted in conspicuous places on the common elements or ~
facilities. The U nit Cwners hereby covenant and agree to be bound by all of
such Rules and.Regulations and said parties shall obey same and be ~
responsible for their being obeyed by the ~aid Unit Cwners, their family, s
guests, invitees, servants, heirs, siicce~sors and assiqns. Should a unit t
~ ~ owner _fail to pay an assessment as required under the terms of this .
L`eclaration for the period of time specified herein whereby said assessmznt
becomes delinquent, the Association may deny the Unit G~vner and/or'the
autharized user of the facilities the use and enjoyment of his parcel ~r
Interval Cwnership until such time as all assessments are paid. The ~
Association shall further have the right in its sole discretion to suspend any a
Unit Cwner and/or authorized user of said fa~ilities from the use of same for ~

a period not to exceed thirxy (30) days for any infraction of the promulgated
Rules and Regulations pertaining to said fa.cilities. Should the Unit Cwner .
or the authorized user of said faciiities rights to use same be suspended;

I Any person who is a Unit Cwner in this Condominium, together witt~
; ~ spouse and other members of said Lnit Cwner's immedia.te family who are in >
I residence in the Condominium parcel, as pr~vided herein, may use the ;
fac'ilities. Where a Corporation is a Unit Cwner, the use of said fa~ilities :
shall be limited at any one time to such offi~er, director or employees of sa.id `
~ . corporation who is 7n actual residence together with his family residing with
~ him and such individual shall be deemed.to.be the Condominium par~~l owner -
for the purposes of this paragraph. Guests and invitees of a Unit Gwner,
whether in tempora.ry residence in the Condiminium or not, may only be '
permitted to use the fa.cilities area, if at all, with the permi~sion of the
Association,and subject to the terms and condit:~ns as the Asso~iation may :
~ determine in its sole dis~retion, including the paynient of additional ~
compensation therefor, it being understood and~ agreed tha.t the use by others
~ may be required to be limited or not permitted at all during certa.in times of
a day, certain weeks or months of a year, and the A ssociation shall ~
determ'ine the foregoinq in its sole discretion, includinq the manner and '
method in whi~h the facili~ies are to be used and under what circumsta. ~es.
~ Notwithstanding the foregoing, where ct~ildren in residence in a Cond~minium
are the sons and/or daughters of the ~a.rcel owner, su~h pa.rent shall not be
~ required to pay additional compensation for use by said children of said
~ facilities. `JVhere a U nit Cwner owners m~re than ~ne unit, the fam ily in
re~idence in each unit ~hall be entitled to the use of the faeilities, whether sai
family in residence be a;essee of said Condom inium unit or ~therwise. ~ilhere _
w R. scorr a pa^ty owns one Cond~minium unit and leases same, the lessee shall be ~

facilities. Use of the facilities by Interval Cwners shall be limited to the
